Within the shari’ah it is detailed, Mecca is forbidden to non-believers.
This is within a treaty called “Ahl Al-Dhimma,” which tranlates to, ‘non-Muslim subjects of an Islamic state’.
The Islamic law of Ahl Al Dhimma are conditions for how a non-Muslim will live within an Islamic State.
Mecca was Muhammads birthplace, he claimed he received revelations there, which he believed were to be divinely inspired by the Islamic God, Allah. Twelve years later Muhammad left, due to facing opposition from his increasing demands the Meccan tribes must accept that Allah as the only God. Muhammad sent some companions to Medina (previously named Yathrib) ahead of himself and then migrated. This point in time was called the Hijra (migration)
The Hijra was the start of the Islamic calender.
When Muhammad migrated, at first he softened the hearts of non-Muslims and some accepted Islam. This wasn’t to last, as within 18 months Muhammad had ordered raids against the Meccan caravans and this very soon turned to the Jihad as we know it; this was primarily directed at the surrounding Medinian towns, which were mainly of Jewish people.
Whilst in Medina, Muhammad built up an army, and placed ‘terror into the hearts‘ of people of Medina, plus the surrounding towns, this was by consistent and brutal Jihad for the remainder of his time in Medina. The people either took the Shahada and converted to Islam, lived as Dhimmis, were enslaved or killed.
Muhammad conquered Mecca when he marched with an army of 10 thousand men, most Meccan people submitted to Islam, some people who were known as an “Enemy of Allah” prior to the invasion, were killed.
A Qur’an verse revealed at this time was, 9.28.
“O you who believe (in Allah’s Oneness and in His Messenger (Muhammad SAW)! Verily, the Mushrikun (polytheists, pagans, idolaters, disbelievers in the Oneness of Allah, and in the Message of Muhammad SAW) are Najasun (impure). So let them not come near Al-Masjid-al-Haram (at Makkah) after this year, and if you fear poverty, Allah will enrich you if He will, out of His Bounty. Surely, Allah is All-Knowing, All-Wise.”
All Qur’an verses are believed to be divinely inspired by Allah and are to be orders until the day of judgement. The laws of Allah (the Qur’an) the orders, prohibitions and actions of Muhammad; the Sunnah and the Sira (biography) of Muhammad were all gathered as a collection of laws of Islam, which is the shari’ah. The prohibition to non-Muslims visiting Mecca and Medina was then entered as a law within Al-Dhimma status, which means the Dhimmi.
The name of the mosque in Mecca is “Masjid-al-Haram,” Masjid means mosque, and haram means forbidden.
It is believed within this context, haram is said to mean sacred, or holy, which is in part true.
This Fatwa explains this in more detail. A Fatwa is a legal Islamic ruling, which can be made by a religiously qualified person in Islamic jurisprudence.
“Why is the masjid in Mecca called as “Masjid-al-Haram”? Normally the word “haram” is used to things that a Muslim should not do.
The word of haram is derived from hurmah which means to be forbidden i.e. things are necessary to be fulfilled and going against it is forbidden (haram). It also means ‘sacred thing’ whose desecration is forbidden (haram). It is also translated with ‘respectful object’; hence, the sense applies to Masjid-e-Haram, i.e. respectful, sanctum whose desecration is haram.

Within the Fatwa, it mentions desecration of the Mosque is forbidden. Non-Muslims are believed to be spiritually unclean, a non-Muslim is not cleansed with the purity of submitting to Allah and this is seen as desecration.
The reasons why non-Muslims are spiritually unclean:
- Creed: Only Islam will be accepted, 3.85, 16.110, 9.29
- Deeds: Non-Muslim deeds are worthless and will result in damnation to hellfire. 2.268, 47.8, 23.63
- Morals: Are corrupt and evil. 2.99, 10.33, 5.63
- Ignorance: Pertaining to the time before Islam. 5.50, 33.33, 16.23
Due to this belief, non-Muslims are prohibited entering Mecca and Medina, plus within the close proximity.
In addition to this non-Muslims are prohibited from visiting any mosque, although if this is for the purpose of “Softening the hearts” with the view a non-Muslim may accept Islam, then this is advised, although this is not preferable.
The Qur’an and ahadith contain numerous references of non-Muslims being unclean.
Non-Muslims are not permitted to touch the Qur’an. If a Muslim believes the person will submit to Islam by reading the Qur’an, then this is allowed, this is also detailed in the shari’ah.
Within a UK Parliamentary Policy for MP’s swearing in on oath, there are provisions made for this prohibition.
This is a quote from the UK Parliamentary Policy of swearing in on oath.
“Those books which may not be handled by non-believers are kept in slip-cases.”
The Qur’an is kept in a plastic slip, to prevent the non-Muslim clerk from touching it whilst handling it to pass to the MP who will be sworn into parliament .
I am unsure whether British Parliament are aware why non-Muslims cannot handle the Qur’an, and whether there would be any amendments to the policy if the reason became public knowledge.
It appears with the evidence taken from Islamic sources, the British government are using Shari’ah. Which within the Islamic laws for non-Muslims, will continually be detrimental to non-Muslims with repeated orders for non-Muslims to submit, for Muslims to enslave, subjugate or kill anyone who does not submit to the judgement of Allah.
The Qur’an verse which ruled the prohibition of non-Muslims visiting Mecca has never been contested by non-Muslims. They have visited since, but only on extremely rare occasions, some by permission, but under extremely strict conditions, they have also visited by stealth.
In 1853, Richard Francis Burton, a British explorer, made a journey into the land of Arabia, whilst there, he visited the cities of Medina and Mecca, all whilst under the pretence of being a Muslim making the obligatory pilgrimage. If the Christian British Explorers real identity had been uncovered the penalty would have surely been death.

To this day non-Muslims have no right to enter Mecca, Medina and surrounding areas. The majority of people believe this to be an extreme Wahabi Saudi Arabian law.
When studying the evidence from the laws of Allah, which all Muslims are obligated to obey, it becomes apparent the prohibition is detailed within the Islamic scriptures.
Mecca is one land where Islam fulfilled the goal to its potential, which is the ultimate aim with Israel and then eventually, all lands. Of which the belief in Islam, is for all people to be living under Islamic rule, with Allah being the only authority in all matters.
